Trump Files New Motion to Suppress Evidence and Dismiss Indictment in Classified Documents Case

May 21, 2024 – Fort Pierce, Florida – Former President Donald Trump’s attorney filed a motion in the Mar-a-Lago classified documents case, asking Judge Aileen Cannon to suppress evidence and dismiss the case.

Docket # 23-cr-80101-AMC – United States v. Donald Trump – Docket Entry # 566 – Defendant’s Motion to Suppress and Dismiss Indictment

Trump is challenging the validity of the search warrant the FBI used to raid Mar-a-Lago and the search that produced the documents at the center of the case. Trump argues that the Federal agents lied in their search warrant applications to the court and was executed in bad faith.

In the same motion, Trump also argues that Special Counsel Jack Smith’s office violated Trump’s attorney-client privilege and seeks dismissal of the Indictment as a result.

This motion is one of several motions currently pending before the Court seeking to dismiss the case or have evidence thrown out. Hearings have yet to be scheduled on those prior motions

Judge Aileen Cannon is presiding over the case. The case is pending in the United States District Court for the Southern District of Florida, United States v. Donald Trump, et al, Docket # 23-cr-80101-AMC. No trial date has been scheduled yet.
