Washington, D.C. – The D.C. Circuit Court of Appeals has denied former President Donald Trump’s appeal, seeking immunity from criminal prosecution by Special Prosecutor Jack Smith for alleged election interference. In a 57-page decision, the 3-judge panel of the Court of Appeals rejected Trump’s arguments, setting the stage for a U.S. Supreme Court appeal.

The Court ruled that any legal immunity Trump may have had while in office did not protect him after he left office as President. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” the panel wrote in a 57-page decision.
Trump has the option of seeking en banc review before all of the Judges of the D.C. Circuit Court of Appeals before seeking review by the United States Supreme Court. Both options are likely to be exercised.
Meanwhile, the criminal prosecution in the United States District Court for the District of Columbia has been stayed, or placed on hold, by Judge Tanya Chutkan.
